These Terms of Service ("Terms") govern the use of www.sentiainstruments.com and the purchase of products from SENTIA Instruments, Inc. ("SENTIA," "we," "us," or "our"), a Delaware corporation based in Atlanta, Georgia, USA.

By using our website, joining our waitlist, or purchasing our products, you agree to these Terms.

1. Website Use

You agree to use our website lawfully and not interfere with its security, functionality, or operation. Unauthorized reproduction, distribution, or commercial use of our website content is prohibited.

We reserve the right to restrict access or cancel fraudulent orders when reasonably necessary, subject to applicable law.

2. Products and Availability

SENTIA develops musical instruments combining hardware, software, and proprietary technologies, including TILES.

Product descriptions, specifications, and images are provided in good faith. Prototypes and pre-production demonstrations may differ from final products.

We may make reasonable improvements during development. Material changes affecting an existing purchase will be communicated to the customer, with applicable cancellation or refund rights preserved.

Product availability, pricing, and release dates may change. Confirmed purchases remain subject to the terms and benefits agreed upon at the time of purchase.

3. Orders and Preorders

All prices are listed in U.S. dollars unless otherwise indicated. Applicable taxes, shipping charges, and other disclosed fees are calculated at checkout.

Orders are subject to payment verification and acceptance. SENTIA may cancel an order due to payment failure, suspected fraud, or inability to fulfill it, with a refund of any payment collected.

Preorders

Preorders secure a product for future delivery. Estimated shipping dates are based on reasonable production expectations and may be affected by manufacturing or logistical circumstances.

Customers may cancel a preorder for a full refund before shipment by contacting SENTIA.

If a shipment is delayed beyond the promised shipping period, SENTIA will notify affected customers and obtain consent to the delay or issue a prompt refund as required by applicable law.

4. Shipping and International Orders

SENTIA currently offers domestic shipping, with international shipping available only for eligible TILES · First Edition orders to supported destinations.

Available destinations, shipping costs, and estimated delivery dates will be communicated before purchase.

International customers are responsible for applicable import duties, customs taxes, and local charges unless expressly stated otherwise.

SENTIA is responsible for delivering products in the condition described at purchase. Customers should promptly report missing, incorrect, or shipping-damaged products.

5. Returns and Refunds

Customers may request a return within 14 calendar days of delivery by contacting inquiries@sentiainstruments.com.

For voluntary returns:

Products must be returned in their original condition, allowing for reasonable inspection and testing, with all included accessories.
Customers are responsible for return shipping costs.
Original shipping charges are nonrefundable unless required by applicable law.
Returns must be shipped within 14 days of return authorization, or within any period required by applicable law.
Refunds are issued to the original payment method after the returned product is received and inspected, within applicable legal deadlines.

SENTIA may refuse or reduce refunds for products returned with damage, missing components, or deterioration beyond reasonable inspection, where permitted by law.

Defective, incorrect, or shipping-damaged products are handled separately at SENTIA's expense, subject to applicable law.

These conditions do not restrict statutory cancellation, return, or refund rights.

6. Limited Product Warranty

SENTIA Instruments warrants its products against defects in materials, manufacturing, and workmanship under normal, intended use.

Warranty Duration

TILES · First Edition: Limited lifetime warranty, valid for the original purchaser for as long as they own the instrument.
Other TILES editions: One-year limited warranty beginning on the date of delivery, unless a longer warranty was expressly provided at purchase.

Coverage is limited to the original purchaser and is nontransferable, except where applicable law provides otherwise.

Covered Defects

The warranty covers manufacturing-related failures affecting electronic, mechanical, and tactile components during normal use, including premature component failure attributable to defective materials or workmanship.

For an approved warranty claim, SENTIA will repair or replace the defective product or component at no cost to the customer, including necessary shipping expenses.

If repair or equivalent replacement is not reasonably possible, SENTIA will provide an appropriate refund or other remedy as required by applicable law.

Warranty Exclusions

The warranty does not cover damage caused by:

Water, liquid exposure, spills, or excessive moisture.
Drops, impacts, crushing, or other accidental physical damage.
Misuse, negligence, or operation outside intended specifications.
Improper electrical connections, incompatible power supplies, or external power faults.
Repairs, modifications, or alterations that directly cause damage or malfunction.
Normal cosmetic wear, scratches, or deterioration that does not affect functionality.

Normal wear exclusions do not apply to premature component failure caused by a manufacturing defect.

Non-Warranty Repairs

SENTIA may offer paid repair services for damage outside warranty coverage.

Customers are responsible for repair costs and applicable shipping expenses for non-covered damage. All estimated charges will be communicated for approval before paid repairs proceed.

Warranty Claims

To request warranty service, contact inquiries@sentiainstruments.com with proof of purchase and a description of the issue.

SENTIA may request photographs, videos, or additional diagnostic information and will provide shipping instructions when necessary. Products must not be shipped for service without prior authorization.

Warranty repairs or replacements do not restart the original warranty period. First Edition lifetime coverage remains applicable to an authorized replacement for as long as the original purchaser retains ownership.

First Edition Benefits

TILES · First Edition includes exclusive benefits described on its product page.

The benefits and conditions presented at the time of purchase form part of the purchase agreement and remain applicable to that purchase, regardless of subsequent changes to product offerings.

Nothing in this warranty limits non-waivable statutory consumer rights.

7. Software and Firmware

SENTIA products may include proprietary software and firmware. Customers receive a non-exclusive license to use this software as necessary for the product's intended operation.

Software updates may provide improvements, fixes, and additional features. Specific commitments to future updates are governed by the product benefits agreed upon at purchase.

Compatibility with every third-party device, operating system, or software application is not guaranteed.

8. Intellectual Property and Creative Ownership

SENTIA Instruments, TILES, associated logos, product designs, software, website materials, and proprietary technologies are owned by SENTIA Instruments, Inc. or their respective licensors.

Certain technologies are patent-pending. Purchasing a product does not transfer ownership of its underlying intellectual property.

Customers retain full ownership of the music, compositions, recordings, performances, and other original creative works they create using SENTIA products.

Nothing in these Terms restricts lawful repair, interoperability, or other rights protected by applicable law.

9. Waitlist, Communications, and Privacy

Joining the SENTIA waitlist allows us to contact you regarding relevant product availability and release information. Waitlist registration does not guarantee availability, pricing, or reservation of a product.

Marketing communications may be discontinued at any time through the provided unsubscribe options.

Personal information is handled in accordance with our Privacy Policy. Certain website features may rely on third-party payment, hosting, or communication services.

10. Liability

SENTIA makes reasonable efforts to maintain its website and provide products meeting their published specifications.

To the maximum extent permitted by law, SENTIA is not responsible for indirect, incidental, special, or consequential damages arising from use of its website or products.

This limitation does not exclude liability for matters that cannot legally be excluded, including applicable consumer protection rights, personal injury liability where legally protected, or obligations under an express warranty.

11. Changes and Governing Law

SENTIA may update these Terms to reflect operational, product, or legal changes. Updated Terms will be published with their effective date.

Changes do not retroactively reduce warranty coverage, First Edition benefits, or other contractual rights established at purchase.

These Terms are governed by the laws of the State of Georgia, USA, except where mandatory consumer protection laws provide otherwise. Disputes are subject to courts of competent jurisdiction.
